Conditions of Use

1. Scope of Validity

   The following general Terms and Conditions of Business shall apply exclusively to all contraPORK-a-Billy Events UG and to all orders issued by us concerning the delivery of tickets and merchandise in relationship to the PORK-a-Billy Events UG.

2. Contractual Conclusion

   1. The offer for a contractual conclusion emanates from the customer as soon as he/she has clicked upon the field "Confirm order". Only upon the assignment and transmission of the transaction number by PORK-a-Billy Events UG to the customer is a contract between the customer and the relevant contractual partner (organizer, licensed fan article vendor or PORK-a-Billy Events UG) concluded.
   2. No guarantee is assumed for the correctness of the data contained in the website of the PORK-a-Billy Events UG.

3. Price Components and Payment Modalities

   1. The prices for tickets may exceed the printed-on ticket prices. You may pay bank transfer or money order. Statutory value-added tax is included in the price. The total price of the order including all fees is immediately due for payment upon contractual conclusion.
   2. A service fee, which varies accoutring to the weight of the order, will be charged for online orders. Shipping and handling are already included. These fees will be displayed in the shopping basket during ordering; in addition to this, there will no further unidentified costs. Gift-wrap will be additionally billed with the relevantly displayed costs.

4. Right of Revocation and Return

   As far as PORK-a-Billy Events UG offers recreational events in the name of the organizer, in particular admission tickets for events, this does not constitute a mail order and e- commence sales contract as pursuant to § 312b BGB (German Civil Code). This means that the two-week right of revocation and return does not exist. Each admission ticket order becomes binding directly following confirmation by the PORK-a-Billy Events UG in the name of the organizer and obliges the customer to accept and pay for the ordered tickets.

5. Wrong Deliveries

   Please check the the delivered goods immediately after receipt to ensure that they match your order, which you can view under "Your Account". In the event of obvious wrong deliveries, in particular incorrectly issued tickets (wrong seat category, wrong event) you will receive a free-of-charge substitute delivery upon return of the already delivered tickets if you inform us of the error in writing immediately after receipt of the consignment. In order to meet this written form requirement, it is sufficient if you send us notification of the wrong delivery in a letter addressed to PORK-a-Billy Events UG, Herrfurthstr.13, 12049 Berlin or by e-mail to the address support@porkfest.de.

6. Limitation of Liability, Exclusion of Rescission upon Certain Breaches of Duty

   1. PORK-a-Billy Events UG is unlimitedly liable in any case according to the Product Liability Act for wilfully or gross negligently caused damages, for malicious concealment of defePORK-a-Billy Events UG as well as for damages resulting from the injury to life, limb or health. Likewise, the liability for damages resulting from the infringement of a guarantee is unlimited.
   2. In the case of essential contractual duties (so-called material contractual obligations), which are based only on simple negligence, the PORK-a-Billy Events UG is only limitedly liable for the replacement of foreseeable, contract-typical damages.
   3. Notwithstanding the cases named under para. 1 and 2, PORK-a-Billy Events UG is not liable for damages that were caused by simple negligence.
   4. The right of the customer, to step down from the contract due to a breach of contractual obligation for which the neither organizer nor the PORK-a-Billy Events UG can be held accountable, nor which is comprised of a merchandise defect, is ruled out.
   5. As far as the liability of the PORK-a-Billy Events UG is ruled out or limited in the above paragraphs, the same shall apply to the liability of the vicarious agents and parties employed in fulfilling contractual obligations.

7. Final Provisions

   1. Solely the law of the Federal Republic of Germany shall apply.
   2. The sole place of fulfilment for delivery, performance and payment is Berlin, as far as the customer is an entrepreneur as defined by § 14 BGB[German Civil Code].
   3. If the customer is an entrepreneur, then the exclusive (also international) legal venue for all disputes arsing directly or indirectly from the contractual relationship is Berlin. This also applies to non-entrepreneurs in the event of international contraPORK-a-Billy Events UG. PORK-a-Billy Events UG retains the right to also call upon any other internationally competent court.
